ISLOM HAMKORLIK TASHKILOTINING XALQARO-HUQUQIY MAQOMI: TA’SIS TARIXI, USTAV EVOLYUTSIYASI VA HUQUQIY TABIATI

Abstrakt
Maqolada Islom hamkorlik tashkilotining (IHT) xalqaro-huquqiy maqomi uning ta’sis hujjatlari, institutsional tuzilishi va xalqaro munosabatlardagi amaliy faoliyati bilan bog‘liq holda tahlil qilinadi. Tadqiqotning asosiy muammosi xalqaro tashkilotlarning huquqiy subyektligini aniqlashda qo‘llanadigan shartnomaviy asos, doimiy organlar va o‘z vakolatlari doirasida harakat qilish qobiliyati kabi mezonlarning IHTning konsensusga asoslangan modeliga tatbiq etilishidir. Maqolada normativ-huquqiy, qiyosiy va tizimli tahlil usullaridan foydalanildi. Tahlil IHTning xalqaro-huquqiy maqomini faqat Ustav qoidalari bilan emas, balki uning xalqaro institutlar bilan munosabatlari va amaliy faoliyati bilan birgalikda baholash zarurligini ko‘rsatadi. 1972 va 2008-yilgi Ustavlar qiyosi tashkilotning institutsional va funksional imkoniyatlari kengayganini ko‘rsatadi. Shuningdek, IHTning o‘zi bilan alohida ta’sis hujjatlariga ega institutlarning huquqiy maqomini farqlash zarurligi asoslanadi. Maqolaning ilmiy yangiligi normativ va amaliy mezonlarni birgalikda qo‘llash hamda tashkilot va institutlar maqomini farqlashda namoyon bo‘ladi. Maqola yakunida IHT hujjatlarining huquqiy kuchini tasniflash va ularning ijrosini kuzatish bo‘yicha amaliy takliflar ishlab chiqildi. Ushbu xulosalar O‘zbekistonning IHTdagi ishtiroki doirasida huquqiy va siyosiy oqibatlarni aniqroq ajratishga xizmat qiladi.
