Abstract

The article provides an in-depth analysis of the legal nature, functions, and practical significance of the collective agreement as the core document of social partnership in the field of labor. It examines the role of the collective agreement as a local normative source, its potential in contractual regulation of labor relations, and the mechanisms of interaction among state authorities, trade unions, and employers’ representatives. Based on the documents of the International Labour Organization, the Labor Code of the Republic of Uzbekistan, and international experience, the scope of application, content, and socioeconomic functions of collective agreements are assessed. The author substantiates the need to improve collective agreements, recognizing them as a key legal instrument for ensuring a balance of interests in labor relations. The collective agreement is viewed not only as a legal document but also as an effective management tool that fosters trust and constructive dialogue within an organization. It directly reflects the needs and interests of employees, encourages employers to make decisions in favor of workers, and facilitates the resolution of everyday labor disputes through open collective negotiations. Furthermore, the collective agreement represents a practical implementation of the principles of social partnership, promotes the development of a culture of collective bargaining, and helps prevent labor conflicts. Its effectiveness directly depends on the activity of trade union committees, the responsibility of employers, and the robustness of organizational and legal mechanisms.
