ENSURING THE LEGALITY OF DECISIONS OF PEOPLE’S DEPUTIES’ COUNCILS: THEORETICAL FOUNDATIONS, NATIONAL MECHANISMS, AND FOREIGN EXPERIENCE

Abstract

This article analyzes the issue of ensuring the legality of decisions adopted by local representative bodies as an institutional-legal problem inextricably linked to the effectiveness of public administration and the sustainable socio-economic development of territories. It highlights the decision-making process at the local level, as well as the legal, organizational, and control mechanisms aimed at ensuring the legality of these decisions.

Using systemic, comparative-legal, and functional analysis methods, the article examines the preliminary, ongoing, and subsequent forms of control for ensuring the legality of local decisions as an interconnected and comprehensive legal mechanism. The legal nature and interplay of legal expertise conducted by justice bodies, prosecutorial oversight, and the institution of judicial appeal through administrative courts are explored.

The article substantiates that ensuring the legality of decisions made by local representative bodies is crucial for strengthening legal certainty, stabilizing institutional relations between the state and society, and increasing the effectiveness of regional governance. The conclusions formulated in the article are of theoretical and practical significance for scientifically substantiating legal reforms in the field of local governance and for improving law enforcement practices.
