Abstract
The article examines the specific challenges of ensuring the security of anatomical and physiological medical data amidst the digital transformation of the healthcare system, which is accompanied by an intensification of the processes of information exchange, collection, storage, and processing of medical data. It is argued that these categories of medical information, being directly linked to a patient's biological identification, genetic, and biometric characteristics, form the core of personal non-property rights, including the right to privacy, honor, and dignity. The article analyzes traditional civil law mechanisms for ensuring medical data security (contracts for the provision of medical services, the duty of medical confidentiality, tort liability, compensation for non-pecuniary damage), as well as the need for a differentiated approach to protecting highly sensitive data. Special attention is given to the development of the institution of consent based on the "informed - specific - purposeful" model, the strengthening of the principles of purpose limitation and limited data use, and the clarification of the duties of physicians and third parties (digital platform operators, insurance organizations, government bodies). The article concludes by emphasizing that protecting anatomical and physiological medical data in the digital era is a pressing task for civil law theory and practice, requiring a strengthened legal regime aimed at preventing violations and creating effective mechanisms for compensating for damages.
