CONSTITUTIONAL PRINCIPLES AS CRITERIA FOR THE IMPLEMENTATION OF THE ADMINISTRATIVE PROCEDURE

Abstract

Taking into account the fact that administrative procedural law is a concretized constitutional law, the article considers the influence of constitutional principles on the administrative procedure. Constitutional principles determine the development, interpretation and application of administrative procedural law. The Constitution establishes the criteria for the implementation of the procedure. In particular, using the example of German law, the article explains in more detail the principles of legality, proportionality, equal treatment, protection of legitimate expectations derived from the principle of the rule of law.
