Abstract

This scientific article provides a comprehensive and systematic legal analysis of the role and importance of collective bargaining as a key institution of social partnership in labor law. The author examines the theoretical and legal foundations of collective bargaining, as well as its stages of development, interpretation in international legal sources, and its place within national labor legislation. In particular, based on the provisions of the International Labour Organization conventions, the legal essence of collective bargaining is analyzed and the necessity of its implementation into the national legal system is substantiated.
The article also justifies the role of collective bargaining as a form of social dialogue, emphasizing its importance in ensuring a balance of interests between the parties to labor relations, preventing labor disputes, and strengthening social stability. The author consistently highlights the legal nature of collective agreements and contracts as local normative legal acts, their binding force, and their role in the contractual regulation of labor relations.
Based on a comparative legal analysis, the experience of countries such as Germany, France, and the United Kingdom is examined, and the possibilities for adapting their advanced practices into the national labor law system are identified. The article concludes with scientifically grounded proposals and recommendations aimed at improving labor legislation, enhancing the effectiveness of collective bargaining, strengthening social partnership mechanisms, and developing effective social dialogue.
