Abstrakt
Товар белгисига нисбатан пародия товар белгисини реклама қилиш, товар маҳсулотлари олди-сотдиси жараёнлари фаол ижтимоий ҳаракат сифатида ўрганилди. Гарчи миллий ва халқаро қонунчиликда пародия қилишни тартибга солиш масаласи қонунчилик даражасида белгиланган бўлмасада, қоидага кўра ушбу фаолият инсофлилик доирасига кўра ҳал этилади. Албатта, айрим ҳолларда товар белгисига нисбатан пародия инсофсиз рақобат мазмунини ўзида акс эттиради ва бу рақобат қонунчилиги ва товар белгилари қонунчилигига мувофиқ тартибга солинади. Шунга кўра, пародияни ҳуқуқий ёки ноҳуқуқий деб баҳо беришдан олдин пародия қўлланилаётган ҳудудда товар белгиси эгасининг ижтимоий мавқеи ҳисобга олиниши лозим.
